Treelance.ai — Terms of Service

These Terms of Service ("Terms") govern your use of Treelance.ai ("Treelance", "we", "us"), an AI-powered talent coordination service that connects energy professionals with recruiters and project opportunities. By sharing your contact information and using Treelance, you agree to these Terms.

1) Definitions

• "Service": The Treelance.ai platform and its functionalities, including messaging via Telegram and WhatsApp, email verification, profile creation, CV processing, job requirement intake, AI-assisted matching, introductions by email, and follow-ups.
• "User": An individual who has shared their contact information with Treelance via the Treelance Telegram bot or WhatsApp Business account and completed the Treelance verification process.
• "Candidate": A User who is seeking work opportunities, projects, or professional introductions in the energy sector.
• "Recruiter": A User who is seeking candidates for roles, projects, or assignments. Recruiters must register with a professional email address (free email providers such as Gmail, Hotmail, and Yahoo are not accepted).
• "Profile Information": Information extracted from your CV, your LinkedIn profile, and any additional information you provide to Treelance during onboarding or conversation.
• "Treelance Profile": A structured, standardised profile generated by Treelance based on your submitted CV, LinkedIn data, and/or conversational data collected during onboarding.

2) Eligibility

You must be at least 18 years old to use the Service. By using Treelance, you represent and warrant that you are at least 18. We may request proof of age and may suspend or terminate accounts of Users found to be under 18.

3) Registration and Service Activation

Treelance operates primarily through Telegram and WhatsApp. Registration occurs in steps:

• Step 1 — Role Selection: You message the Treelance bot. You must choose whether you are a Candidate or a Recruiter. This choice is permanent and cannot be changed.
• Step 2 — Email Verification (Required): Treelance sends an email verification link. You must verify your email to proceed. Recruiters must verify using a professional (company) email address. No further progress is possible until email is verified.
• Step 3 — Profile Creation: Candidates upload a CV (PDF preferred). Treelance extracts structured profile data using AI. You review and confirm or correct the extracted data. Any required fields not found in your CV are collected through conversation.
• Step 4 — Optional Documents (Conditional): For certain roles or jurisdictions, Treelance may request certifications, work samples, or visa/work authorisation documents to confirm eligibility.

4) Profile Sharing and Privacy

Treelance does not publish profiles publicly. There is no public marketplace or searchable database. Your profile is only shared in the context of a specific role match, and only after the double opt-in process described in Section 7. Treelance will not share your private contact details (email, phone) until both parties have consented.

If you provide a LinkedIn profile URL, it may be included as part of your Treelance Profile when shared with a matched Recruiter after opt-in.

5) Marketing Communications

By providing your email and phone number, you may receive:

• Service updates and role recommendations
• Monthly availability check-ins
• Product announcements

You can opt out at any time via email unsubscribe link or by replying STOP on Telegram or WhatsApp.

6) Recruiter Job Posting Rules

Recruiters can submit role requirements to Treelance via Telegram or WhatsApp. Treelance requires a minimum dataset to run matching: role title, required skills and certifications, location and remote/onsite preference, start timeline, contract type, and budget range. Treelance reserves the right to implement posting limits and paid plans in the future.

7) Double Opt-In and Contact Sharing

Treelance enforces a strict double opt-in process for all introductions:

1. Treelance identifies a potential match and presents an anonymised summary to the Recruiter.
2. If the Recruiter is interested, Treelance contacts the Candidate with the role details (without revealing the Recruiter's identity).
3. The Candidate must explicitly consent to being introduced.
4. Only when both the Candidate and the Recruiter have consented does Treelance create an introduction by email, sharing email addresses in that email thread.

No contact details are shared through Telegram or WhatsApp messages. No contact details are shared without explicit consent from both parties.

8) Availability Follow-Ups (Candidates)

Candidates agree that Treelance may message them periodically (typically monthly) to confirm: availability status, updated preferences, role types of interest, and location or rate changes. This keeps the matching pool accurate and ensures you are considered for relevant opportunities. You can stop these messages at any time by replying STOP.

9) Data Protection and GDPR Compliance

Treelance processes Personal Data under the following legal bases:

• Consent (Art. 6(1)(a)): Marketing communications, sharing contact details after double opt-in.
• Contract performance (Art. 6(1)(b)): Providing matching and introduction services.
• Legitimate interests (Art. 6(1)(f)): Fraud prevention, abuse detection, analytics, product improvement.
• Legal obligation (Art. 6(1)(c)): Compliance with applicable laws.

You have the right to access, rectify, erase, restrict processing, port, and object to processing of your data. To exercise these rights, contact privacy@treelance.ai.

10) Data Retention

Unless law requires otherwise, Treelance retains:

• Profile and matching data: While your account is active, and up to 2 years after inactivity or deletion request.
• Communications records: Up to 3 years.
• Marketing preferences: Until opt-out, then removed within 30 days.
• Compliance records: As required by law.

You may request deletion of your data at any time by contacting privacy@treelance.ai. Treelance will process deletion requests within 30 days, subject to legal retention obligations.

11) User Conduct

Users must behave respectfully and must not:

• Harass, discriminate, or threaten other Users
• Attempt to manipulate or abuse the matching system
• Spam introduction requests
• Request bulk candidate exports or contact scraping
• Misrepresent qualifications, availability, or identity

Violation may result in suspension or permanent removal at Treelance's discretion.

12) AI Processing and Third Parties

Treelance uses AI to process: chat messages, CV parsing and structured profile extraction, matching and scoring, and introduction drafting. These AI systems may be provided by third-party providers who process data under their own terms and privacy policies. Treelance ensures all third-party processors meet adequate data protection standards.

All AI-assisted matching decisions are human-reviewable. No introduction or placement decision is made solely by automated processing.

13) No Guaranteed Outcomes

Treelance does not guarantee interviews, hires, contracts, or financial outcomes. Introductions and matches are provided "as is". Treelance is a coordination service, not an employment agency.

14) "AS IS" Disclaimer and Limitation of Liability

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by law, Treelance is not liable for indirect, incidental, special, or consequential damages arising from use of the Service, including but not limited to lost profits, lost opportunities, or damages resulting from introductions made through the platform.

15) Changes to Terms

Treelance may update these Terms. Material changes will be communicated at least 30 days in advance via email or messaging channel. Continued use after changes take effect constitutes acceptance.
